A recent ruling by a County Court Judge threatens the future of red light camera tickets in Miami-Dade County.

Specifically, the ruling says that all cities in the county should have the same rules when it comes to enforcing red light camera violations. 

While this is great news in the battle against these cameras, here are three facts you need to know:

1. This ruling is NOT final

Although this ruling applies to certain cities in Miami-Dade County, it is not final. The case will now got to the Court of Appeals, a process that can take a very long time.

2. This ruling does NOT apply to the entire state

Only a decision by the Florida Supreme Court can affect red light camera tickets state-wide. 

For now, this ruling only applies to Miami-Dade County, and only in certain cities within the County.

Among others, these cities include Aventura, Florida City, Homestead, Miami Gardens, North Miami Beach, Sweetwater, and West Miami.

3. Do NOT ignore that ticket

Even if some cities are not enforcing red light cameras, you should not ignore any notice you receive in the mail.

Ignoring a red light ticket can result in late fees and license suspension. In addition, an outstanding ticket can go to a collection agency where it will affect your credit.

Qué es una Suspensión D6

Una suspensión D6 es una suspensión causada por una multa de tráfico pendiente.

Cuando se le emite un ticket en Florida, tiene 30 días para seleccionar una de las siguientes tres opciones: pagar la multa, asistir a un curso de conducción defensiva, o solicitar una audiencia en el tribunal.

Si no cumple con su multa, la corte le indicará al Departamento de Seguridad de Carreteras y Vehículos Motorizados de Florida (DHSMV) en Tallahassee que suspenda su licencia de conducir.

Razones para una Suspensión D6

1. No pago su multa de tráfico. Si decide pagar su multa, debe hacerlo dentro del plazo de 30 días o arriesgarse a una suspensión. Además, después de 90 días sin pagar, su multa de tráfico irá a una agencia de cobro.

IMPORTANTE: Debido a que pagar una multa de tráfico es una admisión de culpa que genera puntos, no recomendamos que seleccione esta opción.

2.  No asistió a la escuela de tráfico. Si elige la escuelita, debe completar el curso y enviar el certificado a la corte dentro de los 30 días. Si se olvida, el tribunal lo considerará culpable de la infracción de tránsito, impondrá puntos y ordenará una suspensión D6.

3. No asistió a la corte. Si ha sido acusado de un crimen de tráfico, una multa de tránsito con comparecencia obligatoria ante el tribunal (como exceso de velocidad de 30 millas) o decidió luchar contra su infracción sin la ayuda de un abogad de multas de transito, debe asistir a TODAS las fechas requeridas en la corte. De no hacerlo, resulta en una suspensión D6, y dependiendo del caso, una orden de arresto.

What is a D6 Suspension

A D6 suspension is a court ordered suspension caused by an outstanding traffic ticket.

When you are issued a ticket in Florida, you have 30 days to select one of the following three options: pay the fine, attend traffic school, or request a court date.

If you fail to satisfy your ticket, the court will instruct the Florida Department of Highway Safety & Motor Vehicles (DHSMV) in Tallahassee to suspend your driver’s license.

Reasons for a D6 Suspension

1. You failed to pay your traffic ticket.  If you decide to pay your ticket, you must do so within the 30-day deadline or risk a suspension. In addition, after 90 days unpaid, your traffic ticket will go to a collection agency.

IMPORTANT: Because paying a traffic ticket is an admission of guilt resulting in points, we don’t recommend you select this option.

2. You failed to attend traffic school. If you elect traffic school, you must mail the certificate of completion to the courthouse within 30 days. If you forget, the court will deem you guilty of the traffic offense, impose points, and order a D6 suspension.

3. You failed to attend court. If you received a criminal traffic ticket, a ticket which requires court appearance (such as speeding 30 miles over the limit), or you decided to fight your ticket without the help of a traffic ticket attorney, you must attend ALL court dates. Failure to do so results in a D6 suspension, and if it’s a criminal ticket, an arrest warrant.
